The Florida Department of Environmental Protection bill (HB 1417) just passed unanimously on the House Floor. In its last committee, bill sponsor Representative LaMarca amended HB 1417 to remove concerning provisions regarding Basin Management Action Plans that would have setback springs restoration. Both the Florida Springs Council and the Department of Environmental Protection supported the amended bill. The Florida Springs Council thanks Rep. LaMarca for his hard work to improve HB 1417.

What happens next? Now, we need the Florida Senate to pass HB 1417 “as is” without any amendments. The Senate version of the FDEP bill (SB 1510 by Senator Massullo) still includes the concerning 60-day delay for BMAP implementation, which would allow more septic systems to be installed in areas where they would otherwise be prohibited. Each new septic tank decreases water quality and increases the cost of restoration.

Our ask: The Senate should follow the lead of Rep. LaMarca and take up and pass HB 1417 without any additional amendments.

Senators, Pass the House FDEP Bill Without Changes - Protect Our Springs!

I ask that the Florida Senate please take up HB 1417: Department of Environmental Protection by Representative LaMarca and pass it without any amendments. HB 1417 is good, compromise legislation that is supported by the Florida Department of Environmental Protection and conservation groups like the Florida Springs Council. Any amendments to the bill would disrupt the careful compromise struck in the Florida House.

Lines 1363 - 1365 of CS/CS/CS/SB 1510 delays Basin Management Action Plans from going into effect for 60 days after being adopted by DEP. This unnecessary delay opens a window for developers to install more conventional septic tanks in areas where they’d otherwise be prohibited. In some cases, homeowners and taxpayers will then be responsible for replacing these conventional septic tanks with advanced systems. I believe this provision is counterproductive to the significant investments the Legislature has made in water quality restoration projects to restore Outstanding Florida Springs, the Indian River Lagoon, and coastal communities.

Thanks to Representative LaMarca and Representative Boyles, HB 1417 was amended in its final committee to remove this concerning provision as well as other potentially harmful sections that remain in CS/CS/CS/SB 1510. I ask that you please vote yes on a clean version of HB 1417 without additional amendments.
